By accessing our website, placing an order, submitting a custom-order request, or purchasing a product, you agree to these Terms of Service.

About Our Products

81 Degrees West Hobbies LLC specializes in handmade, customized, fabricated, engraved, and small-batch products.

Unlike mass-produced merchandise, handmade products may contain natural or minor variations. These variations are part of the character of handcrafted products and do not necessarily constitute defects.

Wood products may naturally vary in:

Grain pattern
Color
Figure
Knots
Mineral streaks
Texture
Natural edges
Dimensions
Appearance after finishing

Product photographs are intended to accurately represent our work, but individual products may vary because of natural materials, lighting, photography, monitor settings, manufacturing processes, and available materials.

Product Availability

Products and materials are subject to availability.

Some products are one-of-a-kind and may become unavailable after being sold. Wood species, hardware, finishes, blanks, accessories, and other materials may also become unavailable without notice.

We reserve the right to discontinue products or modify product offerings at any time.

Pricing

Prices are subject to change without notice.

We attempt to provide accurate product descriptions and pricing. However, errors may occasionally occur.

If a significant pricing, description, or configuration error is discovered after an order is placed, we may contact the customer to correct the order or cancel and refund the affected portion of the transaction.

Applicable taxes and shipping charges will be calculated as appropriate during checkout.

Custom Orders

Custom work may require consultation before an order is accepted.

Depending upon the project, we may require:

Full payment
A deposit
Design approval
Artwork approval
Material approval
Dimensional approval
A custom quotation

Production does not necessarily begin immediately when payment is received.

Quotes may specify additional requirements or terms that become part of the agreement for that particular project.

Customer Approvals

When a design proof, layout, spelling confirmation, photograph, engraving layout, dimensions, or other approval is requested, production may not begin until the customer responds.

The customer is responsible for reviewing all information carefully.

Once a proof has been approved and production has begun, changes may require additional charges and may not always be possible.

81 Degrees West Hobbies LLC is not responsible for errors contained in customer-approved information, including incorrect spelling, dates, names, addresses, dimensions, logos, photographs, or artwork.

Customer-Supplied Artwork, Logos, Photographs, and Designs

By submitting photographs, logos, artwork, trademarks, text, graphics, or other materials for reproduction, printing, engraving, CNC machining, laser processing, or fabrication, you represent that you own the material or have sufficient authorization to use and reproduce it.

You are responsible for obtaining any necessary permission from copyright, trademark, publicity-right, or other rights holders.

We reserve the right to decline work that we reasonably believe infringes another person's rights, violates applicable law, or is otherwise inappropriate for our business.

The customer remains responsible for claims arising from materials the customer specifically directed us to reproduce, except to the extent caused by our own unlawful conduct.

Handmade Product Variations

Measurements listed for handmade items may be approximate unless expressly identified as exact specifications.

Natural materials move and react to environmental conditions. Wood can expand, contract, change color, develop minor surface movement, or otherwise change over time because of temperature, sunlight, humidity, moisture, storage, and use.

These characteristics are inherent to natural wood.

Order Cancellation

Standard orders may be canceled before fulfillment when reasonably possible.

Custom-order cancellations are governed by our Return and Refund Policy. Once custom design, material acquisition, fabrication, engraving, or finishing has begun, payments or deposits may be partially or completely non-refundable.

Shipping and Delivery

Shipping is governed by our Shipping Policy.

Processing times and carrier transit times are separate. Estimated carrier delivery dates are not guarantees made by 81 Degrees West Hobbies LLC.

If we determine that we cannot ship within a timeframe we have specifically promised, we will contact the customer regarding the delay and available options.

Returns

All returns, refunds, damaged shipments, BLEM products, and custom-order returns are governed by our Return and Refund Policy.

Proper Product Use

Customers are responsible for using products only for their intended purpose and following any product-specific care, installation, operating, or safety instructions.

Products intended for food contact must be maintained appropriately. Wood products should not be placed in a dishwasher or left submerged in water unless a specific product listing expressly states otherwise.

Outdoor and indoor products must be used according to their intended application.

Website Use

You may not use this website:

For unlawful purposes
To violate intellectual-property rights
To transmit malicious software
To interfere with website operation
To attempt unauthorized access to our systems or accounts
To commit fraud
To submit intentionally false information

We reserve the right to refuse or cancel transactions reasonably suspected of fraud, unauthorized payment activity, resale abuse, or unlawful activity.

Intellectual Property

Unless otherwise stated, photographs, original product designs, graphics, written descriptions, branding, logos, website content, marketing material, and other original content created by 81 Degrees West Hobbies LLC remain our intellectual property.

Purchase of a physical product does not transfer copyright or other intellectual-property rights associated with the underlying design.

Third-Party Services

Our website may rely upon Shopify and other third-party providers for payment processing, shipping, analytics, communication, applications, and other services.

Those services may be subject to separate terms and policies established by their providers.

Disclaimer of Warranties

We work to accurately describe and produce our products.

Except for warranties that cannot legally be excluded, products are provided subject to the descriptions and warranties expressly stated in the applicable product listing or custom agreement.

No website photograph or description should be interpreted as guaranteeing that natural wood grain, coloration, or other naturally occurring characteristics will exactly match another product.

Limitation of Liability

To the fullest extent permitted by applicable law, 81 Degrees West Hobbies LLC will not be liable for indirect, incidental, special, or consequential damages arising from improper use, unauthorized modification, improper installation, failure to follow care instructions, or use of a product for a purpose for which it was not intended.

Nothing in these Terms is intended to exclude or limit rights or remedies that cannot legally be waived.

Indemnification

To the extent permitted by law, customers agree to be responsible for claims arising from their unlawful use of the website or from customer-supplied copyrighted, trademarked, or otherwise protected materials that they were not authorized to provide for reproduction.

These Terms are governed by applicable federal law and the laws of the State of Florida, without regard to conflict-of-law principles.

Severability
